Mr. Ferleger has more than thirty years experience in resolving disputes for the benefit of thousands of individuals, as well as numerous organizations and government agencies. He has long been keenly aware of the benefits of alternative dispute resolution (ADR) in all his work, including serving courts as judicial adjunct and serving the executive branch, arguing five times before the Supreme Court of the United States, representing individuals and government agencies, teaching law school, writing, lecturing and consulting nationally.

Perhaps the most important qualities required of a mediator or arbitrator are fairness and neutrality. Mr. Ferleger has served federal courts, presiding over hearings and assisting courts as special master for seven years in one case, and as court-appointed monitor in a large class action in another case. In that judicial capacity, he has brought parties to agreement on dozens of matters. He has argued five times in the Supreme Court of the United States.

In a written decision, a federal judge recently characterized his service this way:

“The Special Master [David Ferleger] is a skilled judicial adjunct who has served the Court with balance and with fairness to the parties.” United States v. State of Connecticut (June 24, 2003).

Mr. Ferleger (University of Pennsylvania, BA (Sociology) 1969; University of Pennsylvania Law School (JD 1972) (not currently admitted to practice) has experience in the judicial branch. For the past seven years, Mr. Ferleger has served as court-appointed Special Master to the United States District Court for the District of Connecticut, presiding over hearings and facilitating dozens of amicable agreements in United States v. State of Connecticut . He also served the federal court in Florida in Johnson v. Bradley as court-appointed monitor. His experience also includes representing the Commonwealth of Massachusetts, including its Governor, in settling amicably five complex federal class action lawsuits, as well as representing individual and class plaintiffs in many other disputes, often reaching major structural change through discussion and negotiation.

Mr. Ferleger's public service work has also included inspection of residential facilities for the West Virginia Supreme Court's Juvenile Justice Committee, and assisting the National Institute of Mental Health, the State of Wyoming, the State of New Jersey, and other bodies as well.

Mr. Ferleger has taught at the New York University Law School and the University of Pennsylvania Law School. Writing has included book chapters, books of legal materials, law review articles, popular magazine and newspaper articles, and the like.

Mr. Ferleger's work has included litigation, appeals, consulting, teaching and writing. His interest has been in both individual and landmark cases, and in initiating and developing the areas in which he has litigated, taught and lectured. He has visited programs in about 30 states and internationally. Mr. Ferleger has broad experience including, for example, areas such as civil rights, employment, academic and university disputes, disabilities, ADA, real estate, housing and investments.

His public speaking for Mr. Ferleger has ranged from an invited presentation for the United Nations Conference in Iceland, to testimony before the United States Senate, to plenary addresses, speeches and workshops at professional and consumer conferences coast to coast.
